BAC Reading from Intoxilyzer Shown Inaccurate
Jill was charged with her 3rd offense of aggravated DWI, and, if convicted, would face incredibly severe legal punishment. The state provided evidence that Jill had a BAC level of 0.18 at the time of her arrest, which was over twice the legal limit. But, Ryan knows that these test readings are often inaccurate, and challenging that accuracy is a key part of a successful New Hampshire DWI defense. Many factors can contribute to an inaccurate reporting of BAC. Whether one is on other medication, how much or how little food had been consumed, and whether it was prior to or after consuming alcohol, are just a few factors that may interfere with accurate readings. Ryan was able establish that the Intoxilyzer data was inaccurate.
Result: Not guilty.
