Discredited Evidence from the Drug Recognition
State Troopers pulled up behind a Merrimac man in an effort to do a “welfare check” with the defendant taking a nap in his vehicle. Thinking the defendant might be under the influence, the State Troopers brought the man to a drug recognition expert at a local hospital to test the defendant for drugs or alcohol.
Board-certified DWI attorney Ryan Russman was able to get the entire case thrown out before it was brought to trial. The drug recognition expert did not follow DWI laws and the 12 step protocol, therefore his evidence was discredited and the blood test was unable to prove any evidence of drugs or alcohol.
